The Boys - you and I disagree on pretty much everything.......however.....I hate that you have to go through this. I don't know if you will listen, but here is what I would do.
1. Become her power of attorney if you aren't already.
2. Put everything in your name.
3. You mother cannot control her own funds by court order.
4. Visit your brother at 2:00am with the intention of sticking a lamp up his ass and turning it on.
Is any of this even possible for you? It is time to take care of business.

Wow. He basically threatened your life and financial security after ripping his mother off of her life savings. I'm not sure what I would do. Not sure if I would handle it personally or take it to the highest authority that would listen to me. What a fucked up guy. It also sounds like he's getting some sort of benefits illegally. Personally I would go straight to Executor. The reason being, your mother can have you removed as the power of attorney by any Tom Dick or Harry lawyer. One call from your black sheep brother and she probably will fold like a beach chair.
The courts have to approve you be removed as executor.
And it sounds like your mom has a soft spot for your brother.

Talked to my attorney yesterday. She tells me the only leverage I have would be to declare her incompetent. My Mother is not incompetent she is gullible. She still works at the age of 88, drives, pays all her bills and is very in touch with the world except when her criminal son takes advantage of her like he's doing here. Fells like I'm stuck watching him talk her into writing checks?????
Set up a trust with all your mother's remaining assets and cash. This way her 'competency' has no bearing. Set yourself up as the first executor and some other savvy family member as the backup. As long as she is agreeable and will sign the papers you will control dispersement of her estate while she lives out her years and when she passes.
As far as starting a war with your brother: Nothing good can come of that. Someone will end up maimed, dead or in jail at best. Write off the $25k. I would think that someone like Pepper here can at least point you int he right direction. Setting up a trust or screw it - have her declared incompetent somehow - an attorney should be able to make it work. A clever attorney could.

My brothers demise started when he was 16 and got busted in school for possession of a Quaaludes. Then he started a rock and roll band, then the pot and coke and booze. He has basically been a looser all his life. He has a real knack for swindling my mother, he's very good at it.
I would beat the living fuck out of him, then turn him into the police and use his email as evidence. I feel for you, but to me it's only going to get worse for your mother. Anyone that makes threats like that is a delusional bully that will cower like a little bitch when smacked in the mouth.
