For the last several months I have been working part time for a law firm. I have absolutely loved it, other than one of the attorneys I work for and now I have a little dilema.

I work 1 day a week in the office and on my free time I do a ton of process serving. I am the person who comes to your door , or your place of business and serves you with a complaint because you are being sued or subpeona you to testify/show up for court/ depositions..........Anyway a few months ago I had to serve a hospital . It was after normal business hours that I arrived on the scene so I assume the legal dept. was closed for the day 9:00pm to be exact. I waited in line behind 2 other familys to speak to the security guard to see who would or could eccept service.When it was my turn approx. 15 minutes later I was as friendly as could be to the security guard and even asked where he was from due to his heavy accent. IRELAND he tells me. He was not accepting service because he was afraid of being fired for doing so. After he made a few phone calls from the lobby where I stood and got no firm advice on what to do we continued to talk about his sybolic necklace that he had around his neck and how long he has been in america and so on. In the meantime I am illegally parked out front and at least 25 minutes or so has passed. Finally after alot of smooth talking and and kissing azz to get what I want, Which was for him to take my complaint he very reluctantly takes the papers and says I better not get fired for this one. So I get a phone call yesterday and one of my attorneys claims that they are claiming the complaint was served in default and that I thrusted into the lobby butted in line threw the complaint on the security guards desk and left without a word................. :shrug:

The old man obviously is lying and now today I have to complete a affadavit explaining what happened, and may have to go to court. Now keep in mind , the security guard was the nicest little old irishman I think I ever met and to be quite honest I worked him over. I do not feel bad for doing my job and doing it well............... :D Thus far I have been successful in all of my service attemps and part of the reason is I make friends with the people I am serving . I really hate the cituation that I am in here..................BIG TIME!!!!!!!!!! Why did he lie though????? He won't loose his job,WILL HE????? Now I have to go into the offfice today and tell it like it really is...........I hate doing it, but the person we are representing can not have this happen.............AHHHH legal loopholes.............I never thought I would bve mixed up with one of these................ :eek:

there's no way a hospital would authoruze a security guard to accept sservice of process. the fact that he held himself out to you as being able to do so could very well cost him his job, especially if the complaint went into default before it made its way to the proper persons. the hospital will undoubtedly challenge the validity of service, which will prolong the litigation and make it more expensive. better course of action probably would have been to wait until the next morning to serve the right people instead of hustling a security guard.

oh man loop that is eactly what is happening .......................it did go into default and the security guard told his people that I butted in line, "thrusted " the papers at him and left befor he could see what they were................. I feel terrible..............( THAT IS NOT HOW IT HAPPENED) That poor old guy probably lost or will loose his job because I signed my affidavit today, telling the truth. I know to much about the man (since we had pleasent conversations while I was waiting for him to accept service)

god I feel bad:( your right I should have waited till the next day for the legal dept. at the hospital :shrug: That particular complaint had an attest date on it that was very close so I did what I had to do..............At this point I don't really care about our client alls I keep thinking of is that man I convinced wasn't going to get fired.................................DAMN!!!!!!!!

GW- I love a challenge, and this particular part of my job(process serving) can be extremely challenging to say the least.Just last week a had a doctor hiding from me LOL his staff would lie to me and all, I almost had to resort to JUSTINSMOM making an appt. to see the DR. because he and his staff were really pissing me off. I don't know about you but I would rather have some one like me serve me than the sheriff.

i can't understand why the doctor's wouldnt welcome you with open arms.......probably doesn't have anything better to do than to go to court and get it taken up the XXX

some greedy lying lawyer trying to steal and confiscate money from him by using the crooked courts to do so

I understand it is a huge inconvience to be served a subpeona ....................WOW then the good doctor will have to show up for depositions in regards to one of his patience/ our client that he made thousands and thousands of $$$ off of already.............Gosh he shouldn't be bothered or asked to do so , should he????? and at a meer $150 an hour that we are aloud to pay him. And what about that good doctor who is human and makes a life threatning mistake and some one loses there mom, dad. brother, sister????? Nah he shouldn't be responsible at all should he...................... :shrug:

I listen to the majority around here bashing attorneys , some jokes are in good fun and some are just so stupid.................They all put there time in and alot of it to chose Law if you all think that you can protect yourself your loved ones , settle a divorce or child custody cituation yourself then do so..................and stop your bitchin.

In closing I guess your either one side or the other :shrug: and I am on the other side and I LOVE IT!!!!!!!!!!!!!!! Thank you for helping me NOT feel bad for the old irish man any more;) HE SHOULDN'T HAVE LIED and now he's screwed OH WELL I was just doing my job the one I LOVE , thank you!!!!!

doesn't sound like a fun job. i had some asswipe serve me with a bogus lawsuit for a car accident i was involved in. not only was the lawsuit a joke, this guy comes to my work and starts talkin shit to my fellow employees. he was lucky there were witnesses.

Shame on you Jim for being so hard on her as she is only doing her job---however if the Dr and/or hospital really wanted to be vindictive they could, after aquiring identity of person/persons responsible for any unwanted intrusions, that might consider placing all current or any future medical bills from this person in earlist time frame law allows to the nastiest collection agency around --and not take any write off and prosecute to full extent of law when opportunity exists--and pray they have filed for bankruptcy with the past seven years.

It is always best to do things cordially and as considerately as possible or what goes around could come back ten-fold.

Ms T This was not directed at you, but was in reference to a job that could cause lots of animousity and if you ruffle feathers of someone with an agenda and the know how they could literally wreak havoc on you for decades if there are any chinks in the armor.

have to agree here.

The friendly thing is great and I am sure works well for you as outgoing as you are, but eventually you run into someone like DTB is referring to.

Make the wrong person feel they were duped, tricked, disrespected or lose a job and it may not be worth the outcome.
You can never know the background details of who is involved.

My advise would be serve them and get the hell out. No small talk or friend talk. It ain't worth it.

Can't you consider something safer like maybe Repo lady.

if you dont want health care, stay away then; no one forces you to pay for a doctor's advice....

how about having some real justice and if a doctor has to sit in court the malpractice attorney and client pay his salary?

how about if there is an emergency for which the doctor could have handled instead of sitting in court, the lawyer and his client get sued for misusing health care resources?

if you think doctor's make too much -- this is America become one....you will work hard and you will be helping everyone you can and will not be screwing anyone up the ass

doctors work their tails off trying to HELP people and dont need attorneys pulling dirty tricks for or against them.....they are crooks

your boss makes a living by lies, deceit, and manipulation.....dont be surprised if there is another lawyer sitting right across the aisle from him doing the same exact thing and you get a taste of the "medicine"

if anyone is a victim, it is those who are lied to, slandered, reputations ruined, and have money stolen from. As well as their employees who out of a job because of court time. And dont forget patients, who cannot see a doctor or get a surgery because of this garbage. Other victims include those who see their insurance rates go up because of this both directly and indirectly because of the lawyer produced current medicine in which millions of unnessary labs and thousands of hospital beds are occupied every day. All in the name of preventing lawsuits. Great service which is being done.

Dr. Freeze- I am sure you and I could go back and forth quite a few times .............There is a story for every medical case and for every legal case.........

I did not intend to offend you or piss you off :D If I wanted to intentional do that , it would have been more obvious.

My original problem was feeling bad for an old irish man who may have or may lose his job , because I did my job. That is the bottom line.........
