For the last several months I have been working part time for a law firm. I have absolutely loved it, other than one of the attorneys I work for and now I have a little dilema.
I work 1 day a week in the office and on my free time I do a ton of process serving. I am the person who comes to your door , or your place of business and serves you with a complaint because you are being sued or subpeona you to testify/show up for court/ depositions..........Anyway a few months ago I had to serve a hospital . It was after normal business hours that I arrived on the scene so I assume the legal dept. was closed for the day 9:00pm to be exact. I waited in line behind 2 other familys to speak to the security guard to see who would or could eccept service.When it was my turn approx. 15 minutes later I was as friendly as could be to the security guard and even asked where he was from due to his heavy accent. IRELAND he tells me. He was not accepting service because he was afraid of being fired for doing so. After he made a few phone calls from the lobby where I stood and got no firm advice on what to do we continued to talk about his sybolic necklace that he had around his neck and how long he has been in america and so on. In the meantime I am illegally parked out front and at least 25 minutes or so has passed. Finally after alot of smooth talking and and kissing azz to get what I want, Which was for him to take my complaint he very reluctantly takes the papers and says I better not get fired for this one. So I get a phone call yesterday and one of my attorneys claims that they are claiming the complaint was served in default and that I thrusted into the lobby butted in line threw the complaint on the security guards desk and left without a word................. :shrug:
The old man obviously is lying and now today I have to complete a affadavit explaining what happened, and may have to go to court. Now keep in mind , the security guard was the nicest little old irishman I think I ever met and to be quite honest I worked him over. I do not feel bad for doing my job and doing it well...............
Thus far I have been successful in all of my service attemps and part of the reason is I make friends with the people I am serving . I really hate the cituation that I am in here..................BIG TIME!!!!!!!!!! Why did he lie though????? He won't loose his job,WILL HE????? Now I have to go into the offfice today and tell it like it really is...........I hate doing it, but the person we are representing can not have this happen.............AHHHH legal loopholes.............I never thought I would bve mixed up with one of these................
