QUEENSLAND'S Attorney-General Kerry Shine says he will appeal sentences handed down against nine males who gang-raped a 10-year-old girl in 2005.

Cairns-based District Court judge Sarah Bradley did not record convictions against six teenage attackers and gave three others aged 17, 18 and 26 suspended sentences over the incident at the indigenous Aurukun community on Cape York.

The girl had "probably agreed" to have sex with the youths, Judge Bradley said during her sentencing remarks, The Australian newspaper reported today.

Mr Shine today met with Director of Public Prosecutions Leanne Clare for urgent advice, and determined the October sentences would be appealed, even though the deadline had passed.

"I am truly horrified by the circumstances of these offences," he said in Brisbane today.

"The law should be consistent in its application, whether it be in Aurukun or Clayfield."

Premier Anna Bligh has ordered all Cape York sexual offence sentences to be reviewed, to ensure there was not a trend of leniency.

"The nature of the sentences in this case are so far from community expectations I have to say I am alarmed, and I am not prepared to just write this off as an unusual one-off case," she said.

Opposition justice spokesman Mark McArdle said the penalties the prosecution sought should also be investigated.

"How did the DPP fail to put any evidence before the court, any submissions warranting a custodial sentence, and why didn't the DPP's office insist on a custodial sentence in these circumstances?" Mr McArdle said.

He was also concerned that the victim was said to have agreed to sex, as children could never consent.

Prime Minister Kevin Rudd said he was also "horrified" at the case.

"I'm disgusted and appalled by the reports that I've seen in today's newspapers on this case," Mr Rudd said in Brisbane.

The comments of Justice Bradley were swiftly condemned by prominent Brisbane-based Aboriginal academic Professor Boni Robertson, who called for her to step down.

"It's actually undermined everything we have worked for over the last 10 years to get our women justice in this country," Prof Robertson said in Brisbane today.

"There is something even more sinister ? it's actually given a very clear message to perpetrators out there generally.

"I don't care that they are black, white or whatever.

"I think it's allowed perpetrators to think if you can come up with a defence that she asked for it or she condoned it, then that gives them a sense of leniency."

Ms Bligh said she was not aware of the sentencing until today, but knew of the child involved.

In 2006, an officer from the Child Safety department was dismissed after placing the girl into the Aurukun community from foster care.

She is now back in foster care, receiving medical and other treatment, and is reportedly doing well, Ms Bligh said.

Ms Bligh and Mr Shine did not join others in calling for the sacking of Ms Clare and Judge Bradley.

Not that I've been following this story closely at all (other end of the country to me), but it occured in an aboriginal community...

Like I said tho, don't know enough about it really...

...although this strikes me as an odd thiing to say:, "I think it's allowed perpetrators to think if you can come up with a defence that she asked for it or she condoned it, then that gives them a sense of leniency."

er, if she condoned it, it probably isn't rape?! :shrug: (Obviously not in a 10 yo's case tho! :nono: )

actually thought of you when i read the article. that's right up there with some of the shit that goes on here! crazy shit!

in the states statutory rape is a strict-liablity crime meaning mens rea is not needed. but... under 12 is child rape.

Lets say the girl was 13 but looked 17... her consent doesn't mean shit. you're still gonna get charged w/ rape 2 and do time.

One of my teachers gave this example. He defended a guy that got charged w/ stat. rape. The girl he took out one night was actually 15. Here in alabama... you must be 16 to give consent. He took her to dinner and then they went to a bar... since she told him she was 21. She pulled out a fake and got in with him. They ended up having sex and her parents found out about it.
Got charged w/ rape 2. Keep in mind... he thought the girl was 21 the whole time.

Rape follows you for the rest of your life... since there is notification laws.

we were setting up speed traps looking for the

I look up and notice a car being driven by MrChristo speed by my cop car.

I pull him over. walk to the window ask for his licence and registeration.

he says something out of line. like smart mouth

I pull him out of the car by his tie.

he struggles some so I hit him behind the ear with my billy stick

I kick him in the nuts to get his attention. and search all his pockets, pulling out his drugs and money

He curses at me.

I put a knee on his head to hold him in place.

pull out my taser, tase him . he is flopping like a fish. I hit it again with 10 thousand volts.
He starts to drool so I stop

he seems to lose consciousness.

I pull out my .38

Just to expand slightly...

...the aboriginal communities were set up (well, not exactly set up...recognised maybe) in part because the aboriginals wanted to live on their own land and run their own affairs, seperate from the "white man"...which is all fair enough, and in theory isn't a problem...

...but then of course something like this occurs, which to you and me (and most in western culture) is quite disgusting...yet in aboriginal culture may not be viewed as such a horrible crime...

...yet, then we get Aboriginal leaders, who are the front runners in wanting to keep their own identity/culture etc...now they are the first ones to jump up and down and wanting to bring in western law and the court system into the whole affair...which they may well be right about!!...
...but still, it does tend to make things very, very messy indeed...especially when (on the other hand) people in the 'white' system of law don't particularly want to get involved with the aboriginal affairs...

ah yes, nasty stuff. Complicated, complex, but still very nasty.
