Patriots owner Robert Kraft could have solicitation of prostitution charges against him dropped, with one key condition: He needs to admit that, if the charges hadn?t been dropped, prosecution would have resulted in a conviction.

That?s the latest report from Andrew Beaton of the Wall Street Journal regarding Kraft?s Palm Beach County legal entanglement. The criminal charges will go away if Kraft makes that admission, if he completes an education course about prostitution, if he performs 100 hours of community service, if he?s screened for STDs, and if he pays some of the court costs.

It?s unclear whether Kraft will accept the offer, and it?s unclear whether the agreement (if accepted) would result in a violation of the NFL?s Personal Conduct Policy. It?s possible if not likely that admitting hypothetical guilt under undisputed facts would result in a finding by the Commissioner that punishment is required under the Personal Conduct Policy.

Questions have emerged regarding the viability of the prosecution, including whether the evidence shows actual solicitation of sex in exchange for money. Although the broader investigation was sparked by concerns regarding human trafficking, court documents show that Kraft interacted with a 45-year-old manager of the spa and a 58-year-old spa employee, both of whom are Florida residents.

It will be interesting to see what happens if Kraft declines the offer, essentially telling the prosecutors that if they believe they can prove guilty beyond a reasonable doubt in court, they should go ahead and try. Indeed, if prosecutors were so confident of a victory, why would they offer this kind of a deal?

Prosecutors in Florida have reportedly made an offer in the solicitation of prostitution case they brought against New England Patriots owner Robert Kraft.

Both of the misdemeanor charges against him will be dropped if he admits that he would have been found guilty had the case gone to trial, according to the Wall Street Journal. Kraft would also have to take an education course on prostitution, complete 100 hours of community service, subject himself to an STD screening test and pay some court costs.

Last month, Kraft was among dozens of men charged in the case. Prosecutors allege he visited the Orchids of Asia massage parlor in a Jupiter, Florida, strip mall on Jan. 19 and Jan. 20, 2019. The second visit was on the morning of the AFC championship game. The 77-year-old was charged with two misdemeanors and has thus far entered a plea of not guilty. Other defendants are being offered similar terms, according to the Journal.

So now Kraft has a decision.

Getting the charges dropped is no doubt appealing, particularly if it increases the likelihood that video of the incidents, which police say exists, never see the light of day and cause further humiliation to all involved. Presumably, getting that sealed and locked away is a high priority. However, agreeing that any proceedings would have resulted in a guilty verdict likely opens Kraft up to punishment from the NFL under its code of conduct. It isn?t the same as admitting guilt, but that is one fine line to walk.

Kraft, via a spokesperson, previously released a statement stating, ?We categorically deny that Mr. Kraft engaged in any illegal activity.?

The statement doesn?t say Kraft had never visited the massage parlor. Nor does it say that if he did, he just got a legal back rub.

It?s why in the court of public opinion, Kraft is guilty and he?ll have to deal with the embarrassment and cackling fans during Patriots road games. But what of the NFL punishment?

After the arrest, the league reminded that ?our personal conduct policy applies equally to everyone in the NFL. We will handle this allegation in the same way we would handle any issue under the policy ? we will take appropriate action as warranted based on the facts.?

The most comparable case involves Indianapolis Colts owner Jim Irsay, who in 2014 was sanctioned by commissioner Roger Goodell following an arrest on drug charges during a traffic stop. Irsay, an admitted alcoholic who had battled substance abuse issues, was cited for possession of controlled substances and had blood tests that revealed the presence of ?oxycodone and/or hydrocodone.?

Goodell delivered a six-game suspension and $500,000 fine, banning Irsay from the Colts facility, games, practices or league functions. He was even prohibited from tweeting about the league.

?I have stated on numerous occasions that owners, management personnel and coaches must be held to a higher standard than players,? Goodell said in a statement at the time.


So now here is Kraft, who can?t even (or is unlikely to) cite a health issue such as a substance addiction to explain himself.

Kraft can begin to put this behind him, but he may be staring at the same NFL penalty, or even longer. That particularly stings because New England will unfurl a sixth Super Bowl banner on opening night in the kind of celebration Kraft, or just about any team owner, has enjoyed in the past.

Kraft could also try to negotiate for better terms or even fight the charge and somehow beat the evidence, although a trial where videos are shown would be an improbable strategy.

While the case was originally heralded as part of an anti-human trafficking operation, no charges for that crime have been filed. According to police reports, Kraft interacted with the 45-year-old manager of the spa and a 58-year-old employee.

That may be one reason why prosecutors are apparently ready to move on.

Kraft can start that process, but while the legal issues are his first concern, the NFL is waiting as well. Due to the high-profile nature of this incident, Goodell is in no position to offer leniency to make it all fade away.

Of course he won't, the arrogance and ego on these guys is bigger than most will ever understand (insert Patriot fan saying "maybe he isn't taking the deal because he isn't guilty!!!!").

The funny thing is if he took the deal he would likely also get a slap on the wrist from the league and all of us would forget it in no time because we don't really care if he wanted to get a blowjob from a prostitute or not, we really don't. If he thinks we don't know a lot of those rich old bastards are paying for it on the side he's kidding himself.

Dragging it out, letting a court hearing get on the news and dealing with the aftermath of being found guilty will be much worse, but at least then he can deny it for the rest of his life and say the court got it wrong.

WEST PALM BEACH, Fla. ? Attorneys for Robert Kraft and more than a dozen other defendants facing charges in the Orchids of Asia Day Spa sex-for-pay case Wednesday filed court paperwork asking that evidence, including videos of sex acts, not be publicly released.

Kraft, 77, owner of the New England Patriots, was accused twice in January of visiting the spa in Jupiter, Florida and receiving sex acts, records show. He faces two misdemeanor prostitution-related charges.

His arrest was part of what law enforcement authorities called a human trafficking crackdown that closed several day spas and resulted in dozens of arrests.

According to records, covert video surveillance equipment recorded footage of Kraft and others.

A ?joint motion for a protective order? in one of the men?s cases included Kraft and others.

The filing states that the video recordings and other evidence have not been produced in the court process of ?discovery.?

That?s the procedure by which defense attorneys compel prosecutors to turn over all evidence they plan to use in the case. Once the material is turned over to defense lawyers, it also becomes public record.

Scott Skier, attorney for Joseph Daniels, said he decided to join the filing in the interest of his client.

?I thought it was an appropriate pleading under the circumstances to take a preventative stance on any release of videos that have an evidentiary basis that could be used against Joe,? Skier said. ?It really is a prophylactic measure.?

Kraft?s attorney, Jack Goldberger, did not respond Wednesday to phone messages or email.

The filing also notes the materials are exempt from public disclosure because they are ?active criminal intelligence information.?

The filing further states that while defense attorneys don?t agree there is a ?victim? in the case, they note the ?mere possibility provides an additional basis for maintaining the confidentiality of the materials.?

New England Patriots owner Robert Kraft doesn?t want video of him inside Orchids of Asia spa to be seen by the public. The 77-year-old Kraft asked the judge overseeing his solicitation charges to suppress the video evidence, according to Ken Belson of the New York Times.

Police claim to have video that shows Kraft involved in a sex act from a masseuse. Kraft?s legal team has argued the video recordings are a result of an ?unlawful? search. In the filing, Kraft?s team said police spied on ?Kraft and others, while they were in the private rooms of a licensed spa [the ?Spa?], receiving treatment from licensed masseuses,? according to the Times.

The motion to try and get that evidence suppressed was expected by Kraft?s legal team. Given Kraft?s status within the NFL, the footage could be particularly embarrassing if released.
While Kraft?s legal team will fight to keep the video under wraps, it may prove tough for that to happen. A Florida sheriff said it would be tough for Kraft to get his way given Florida?s open-records law.

On top of that, various news organizations have filed a motion against Kraft?s request, according to the Times.

In their filing, the news organizations said that the Florida constitution ?does not provide a right of privacy in public records.?

In addition, ?Florida courts also reject the notion that simply alleging embarrassment alone is sufficient grounds to defeat Public Records Act disclosure mandates.?

The judge will appear at a hearing April 9 to schedule the rest of the proceedings.
