My wife drives a 2005 Maxima SE with 101K miles on it. Been in the back of our minds to replace it.

Not NOW!

She got hit by an old lady that didn't stop at a 4-way stop and it did $7600 in damage. The insurance company, Allstate, wants to fix it?! WTF?

I had been figuring that we could get around $8K to $9K for it prior to the accident. Now we'll never be able to sell the damn thing. Fucker has been burning oil and gets valve taps, prior to the accident too.

What are my options, if any? :shrug:

First thing I would do is re-evaluate what I thought the car was worth. If it's in premium condition it MAY bring the low end of what you thought it was worth.

Otherwise, WTF is up with the insurance company? No way they should want to put that much money into that car.

I did call him and asked that they pay ME the repair costs instead of paying to have it fixed, plus they would get salvage value from it, making it a better deal for them AND me.

He said he didn't that that was unreasonable and will get back with me tomorrow.

I'm suspecting that the other insurance company has some clout in this decision since they will be reimbursing Allstate after everything is said and done.

Thoughts?

kelly blue book has it at approx $7200 if it's in good cond.

If you look on autotrader, they sell for a lot more than that with a lot more mileage on them too.

I'd be very happy with the $7600.

So would the wife.

Otherwise, I'm stuck with the damn thing. I'll never be able to sell it.

Repair shop and Allstate both are guaranteeing the repairs for the rest of the time we own it. That sounds very strange as well.

Secondly, you don't have to have it repaired at all. Thirdly, if they give you a check for the repairs then you keep the car and sell it for salvage yourself and put the money in your pocket. They only get the car if they total it out...........I am heading out the door right now, but shoot me an email and I'll get you my number and you can call me in the morning and I'll help you out.

Actually the owner of the repair shop told me he sent them the quote and said it was totaled and Allstate replied that they want it fixed.

Just telling you what I was told.

When I asked my agent to just give me the repair costs he stumbled and had trouble giving me an answer, just blowing me off until tomorrow basically.

At first he said that would probably be no problem but I would get the repairs costs MINUS the salvage figure. I said, WTF Jerry (I said it nicely - we're on very friendly terms), that way you guys make out like bandits and I get totally screwed. That's when he deferred to a discussion tomorrow.

First of all if it has $7600 in damage it must have fucked it up pretty good. If its not "totaled" you shouldn't have any issues selling it after repairs because when a vehicle is condemned/totaled a salvage certificate is issued. Then if someone decides to fix the car after the fact they will need to obtain a "reconstructed title" and that's when it's a bitch to sell it
I'm shocked that they decided to fix the car if its that close to the value of it. I don't know how well you know your insurance agent, but I'd be suprised they wouldn't be willing to total the car if that's what you really want. Good luck

This is exactly correct, Jack.

These fuckers try this scam every single time, and more often than not, they get away with it. They will automatically write the check to you and the repair place you got an estimate from. That is BS. You are insured for your LOSS, NOT for the cost of the car repair!

Tell them you'll take the $7,600. I'd even let them have the car! You aren't getting shit for it from a salvage company, and your time is worth more than the money they will toss you, IMO.

Exactly. I've been hit a few times and you find the highest estimate around town that you can and submit that one and you get a check in the mail.

OK. Just saw the pics of the car. Now, I would reconsider giving the car up. Someone will buy that from you, and haul it away. There are plenty of good parts to be had on that car, and thousands to made by someone.

You could easily dump it for 5 beans, if not a few bucks more.
