Yah know it just ****ing sucks dude. It isn't a personal attack against YOU. It's MY opinion after having had this touch my life and forever impact my life. I would have the same feelings if anyone else posted the same thing.

I'm going to try to keep this civil, but this will likey be my last post on the subject.... Again, I am sorry for your personal experience, but you just don't seem to understand how the legal system works....

An attorney zealously represents his clients within the parameters of the legal system. Who says that the "Police officer is always right"?!?!?!? Bet Rodney King didn't say that??? You know nothing of Constitutional rights or just blantantly are prepared to disregard them.... While I do not know all of the facts of this particular case, what if the officer made an invalid stop? I'm not saying that this applies here, but unlike you, I am not prepared to give up my freedoms for communistic society.

I assume that you don't understand that while "technically" .09 is over the legal limit, the state imposed legal limit was .10 only a couple of years ago.... Let me guess, you don't drink at all!?!?! ...a teetotaler, I presume.

If the law was "ye shall not imbibe and drive," I could see you point, but according to a "machine," he was barely over the "new" legal limit.... Machines often don't get calibrated and very often give mis-reads.... Truth be known, the machine might not have been calibrated correctly and he could have very well been under the legal limit. ever had a computer malfunction??? Go figure, the same thing happens with BAC machines.... You make it sound like he was "stumbling drunk" and couldn't operate a tube of toothpaste. unfortunately for you/thankfully for the rest of us, your biased opinion is not the law.

I hope what happened to you doesn't happen to me or anyone else for the rest of eternity.... I understand your strong feelings about the subject, but everyone that gets charged with a DUI should not be locked up with a life sentence...and as far as MADD goes, forgive me, but humanity has suffered through the Crusades once already.... No need to burn them all at the stake. Geeze.

...and if you came to my office with a CIVIL action against a drunk driver that did what he/she did to your family, I would take your case. I would also tell you that unless he has deep pockets, I wouldn't take it ona contingency.... There is no "punishment" on the CIVIL side of the law.... Sorry.


If I were a criminal lawyer and Blazer came to my office, I would represent him to the best of my ability.... That's what keeps out system in check. Unfortunately, you are currently wearing blinders and don't realize that fact. Call me when you, like one of my prior clients, get pulled over and charged for a DUI and both the breath test and blood test come back negative.... Unfortunately, some police officers, just like some lawyers...and some computer programmers, are as sorry as dog shit....

I wonder if The Hillbilly Sage would still represent Blazer if instead of just a routine traffic stop where the defendant was legally drunk, that Blazer had used his vehicle while legally impaired and was involved in a fatal accident. I believe the term is Vehicular Homicide.

I never claimed to understand the law. Again, I will post that this is NOT a personal attack. S-Love is personally attacking. I am stating how I feel, having had this impact my life in an earth shattering way. I would be posting what I am no matter who posted this post.


For the record, I work in the IT Department of a large company while attending school, studying Neuroscience and NeuroSurgery. I have already seen countless TBI's due to DUI's on my clinical rotations. And you are right, unfortunately, some police officers, just like some lawyers...and some computer programmers, are as sorry as dog shit....I hope we never meet under professional circumstances.

End of discussion for me.

obviously you were drunk enough to make the bad decision to take the breath test and not stall it out and get yourself to the police station to give your blood test

Not sure about Tenn, but in KY that is not true. I know many DUI cases where people refused a brethalyzer took the blood test at the Hospital and got less then a year even after the blood test turned out over the legal limit.

how is blowing a .09 and the legal limit being .08 a "technicality"?

I'm going to use that one next time I get a parking ticket.

Judge, the parking meter expired just 2 minutes before the cop walked past and gave me a ticket. So really, that was just a technicality that he got me on so I don't have to pay the ticket.


Bookie, I know I had Team X +6 points, but that extrapoint that Team A kicked to win by 7 was just... well.. a technicality. Please send me my winnings.

Certainly sorry to hear about KMA's loss.

I'll hazard a guess though-

1) it was not the first offense by the drunk who took his family members' lives .

2) that killer was probably way over .09

just guesses based on how these things tend to be. the legal limit doesn't even adversely affect some people. YES - it's in your system and you are affected - BUT - it's very minimal for most. Driving sleepy, angry, or distracted is far more dangerous than driving right at the limit for most people. I can certainly understand Blazer trying to catch a break. Everyone makes mistakes.

Freeze- Same in Tenn. If you don't blow, you lose your drivers rights for a year. I thought I was legal so I blew. I was only over by .01.

Mama- If I slammed 4-5 beers in the first hour and then had one beer per hour then I may be over. I was drinking steadaly and eating pizza.

THE MACHINE IS WRONG.

I was not drunk, I didn't drink enough to be that level. Hell, I was drinking PBR (basically water) at a reasonable rate.

You have motivated me to fight for my rights.
