doc, do not move to TN. you are required to take the test or lose it for a year. you can apply for a restricted afterwards.

there is a town near me I never really have to drive through, but it is one of the possible routes I can take to get to a friends house. I DO NOT drive through this town anymore. I was pulled over by the same cop twice, in a few weeks span for absolutely nothing. I mean he made up stuff like my truck crossed the center line (did not happen). My best guess is this officer was trolling for Drunks. I was driving late at night through this small town and this officer must see so little traffic at this hour he must figure odds are a good percentage of the drivers are drunk, I was not. We both knew that is what he was doing and after a brief conversation and him realizing he guessed wrong this time he sent me on my way. After the first time I said OK no big deal, but after the second time he actually asked me "didn't I pull you over before". Well like I said, I avoid driving through this town unless I have to...

Not a cop basher here, I love the cops, always support them, I work in Law Enforcement, but like in every profession you always have a few over zealous people

There is one thing about being a habitual drunk and another to blow border line on single occasion--especially considering it was below borderline not that long ago---had it been 2nd offense I'd sing a diff tune--Its not those that have a couple drinks at watering hole after work that scare me--it's those with cell phone in one hand and fixing hair in mirror at same time that cause me concern.

I'm just reading Blazers and KMAs initial posts as I don't have the time right now to go over the entire three page record of this most interesting discussion however, what jumps out at me initially is that KMA states that Blazer admits that he was drunk.

I disagree. He admits that he blew in at a .09 which I do not believe is an admission that he is drunk. Secondly, I disagree with Blazers statement that .09 = guilty. Although not an expert by any means in criminal, DUI or Tennessee law, I would assume that a .09 bac does not mean "guilty" but rather is some other presumption under Tenn. law.

My other thought is that KMA's position is emotion filled and rightfully so. Unfortuneatly we do not live in a world were accidents do not happen. This is hard to say but here goes, I somewhat agree with (gulp) Dogs that Bark that if this was a habitual offender than the justice system failed.

KMA where do you draw the line. What if someone has a sip of merlot and later that evening is involved in a serious injury or fatal accident? Do you depend on a machine that may have been calibrated some time before to determine if that person was in any way impaired.

How about the person on the cell phone who runs the stop sign? To me, they know that they are not giving there full attention to the road? I mean if you've ever talked on a cell phone and drove you know some of your attention is given to the call.

How about the person with one arm on the wheel? Should he or she have had both knowing that it would have been safer. You know, I'd love to say equal justice for all in a perfect world. But then again we live in a world where Dr. Freeze gets to practice medicine. So we make do.

Should you fall on the sword every time you do something wrong. Thats up to the individual. I see people everyday wait for the walk light to turn on before they cross the street. Others are dodging cars and flipping drivers off for going through a green light. Who knows.

Sometimes in our world the punishment doesn't seem to fit the crime. In the last 15 or so years, MADD and other such groups have made drinking and driving laws very tough. Employers look closely at these records where for the isolated mistake it may be worth the persons while to get it reduced. For the repeat offenders, I believe we need tough laws to prevent them from driving and agree with you.

Whatever happened to that breath thingy that goes into the car that wouldnt let you start it unless you were sober? Of well just your ambulance chasers point of view. I remain,

It's all about money. Where would California be without the fine money from 178000 DUI's last year? They even have "double fine zones"

Then there's the school program you need to attend at your expense and your higher insurance premiums for the next five years and let us not forget our good buddies, the lawyers.

A lot of people have problems with lawyers because the law rules, every country has them, and lawyers have knowledge of the law and how to apply it and a lot of people don't! Sure there are lawyers that abuse the system, but the same goes for every profession. I hate when an attorney abuses the power because it looks bad for everyone, once again this goes for every profession though....
