And correct me if I am wrong, but wasn't there an investigation done by the police that cleared resulted in no further action taken?
1998. Investigation on Sandusky done by the Penn State police department. The District Attorney declines to file charges.
So now, the State judicial system should be on the hook as well for knowing about it, investigating it, and not taking further action.
So you've got a situation where years earlier an incident was reported and moved up the food chain and no formal disciplinary action was taken.
A few years later the same incident happens and suddenly Paterno is fired and painted as a horrible person.
Does the fact that the DA declined to file charges absolve JP from his moral and ethical responsibility to prevent JS on campus with kids? Or is it....he was cleared legally, so despite the fact that I have a direct report of a minor being assaulted I can bury my head in the sand and allow that monster to continue to be around children?
That's the debate here. There's no debating legal obligations, after all there is the law of the land to tell us that. But, then we have moral obligation, and there are no hard-set rules for something like that. However, the "collective moral", the people of this country, all feel pretty much the same. Who doesn't? Primarily people with some sort of attachment/relationship with PSU. Whether it's as an alum, a fan, a resident. Who is biased here? Surely not the collective moral?
Sure, there is a lot of sensationalism in our media. There is with everything. But if you break it down to the few known facts there was still a moral obligation for JP to have done more. What made him such a great man? I'd argue it was his willingness to do more than just the minimum. Unfortunately for him, and more so for the kids, he chose the wrong time to stray from the ideals that made him who he is/was.
Here's the rub:
A higher authority - the District Attorney said there was nothing there to press forward with charges.
District Attorney > Joe Paterno
So we're destroying a man for his actions (or inactions) after someone higher than him has previously said - that was not a crime.
This is emotional based decision making at it's worst.
Allow me to bring back an old incident that was horrible due to the emotional outcry of people trying to show how pure their own lives are compared to the rest of us:

we all know how that played out once people got done thumping their chest about how pure and holy they are and demanding justice from the horrific sinners.
I'm surprised that Sandusky's attorney let him do this interview....I may be way off base here, but if he did allow this, then I wonder if Sandusky can claim malpractice....May be one of the lawyers here can address this for me....

Under oath, an eye-witness saw a child being sodomized. You cannot argue this, it has been stated under oath by a direct person witnessing it. You tell me, is that a crime? By the letter of the law, yes it is. It's obvious why the DA didn't proceed with charges, there were back-door handshakes. No I cannot prove that. However your case of the DA not pressing charges = no crime took place is completely false.
This one is too easy to argue. There was no witness in the duke trial, just the accuser's word against the team. In this case we have 8 accusers and TWO eye-witnesses who directly witnessed assaults on TWO separate occasions. Not only McQueary see what he did but a member of the janitorial staff witnessed Sandusky performing oral sex on a child How are you even arguing this?

Mqueary says that he saw the rape going on in the shower that night in 2002 and stopped it and went to the police with it.
The Nov. 8 email from McQueary to a friend, made available to The Associated Press, said: "I did stop it, not physically ... but made sure it was stopped when I left that locker room ... I did have discussions with police and with the official at the university in charge of police .... no one can imagine my thoughts or wants to be in my shoes for those 30-45 seconds ... trust me."
Again, I ask. Why is Paterno the scapegoat with this?
WE are destroying a man, who continued to allow his FRIEND a MONSTEr to use Penn State as his carrot to entice these young boys, who he was forcing to have anal sex with him in the showers of PENN STATE!!! Joe Pa knew in 1998 something wasnt right with his FRIEND, thats why he was fired all the sudden, however JOE PA continued to alllow him to use the football program, including trips to bowl games with hotel rooms, where the MOSTER brought these children. JOE PA is not the MONSTER but he is DAMN CLOSE in my opinion and this lets let the facts come out our the chants for Joe Pa really piss me off. Joe Pa continued to provide this Monster the opportunites for 13 FUCKING years. UNREAL.
Also, just recently out, 4 months ago Joe Pa gave his half of the house to his wife for $1. There is no reason to do this, no tax reason, no benefit, she gets it at his death. Oh yeah, there is 1 benefit, it is no longer his asset for the victims who are going to SUE the shit out of this provider. What a fucking loser. Why isn't the sign for the police department being stripped down? Why are they etching his name off trophies, and not crucifying the people that actually had the specific power to stop this?

Wholeheartily agree with this Marine. I also heard on the radio today that McQueary says after he stopped the incident he went to the police with it. Funny... there is NO REPORT on record of this (according to the news on the radio). Now how in the fuck can there be no report on file if he alerted police to he witnessed a 10 year old kid getting sexually molested???
So.... they may as well take down the entire police department while they are at it.... right Saint?
