Well, summer is going well. We've had a lot of lake days. I'm really enjoying the extra time with the family. We went out of town for a week to visit my aunt and uncle who are like another set of grandparents to the kids.

Mom has had surgery. There was a complication with a leaking duct afterwards and they had to perform a second surgery. She just got out yesterday after spending close to 3 weeks in the hospital. But she is on the mend and happy to be out. She has an appointment with the surgeon on Wednesday to find out if she can go back home.

Last but not least, I was served with subpoenas to . appear/testify in court for Aliyah,Kaitlin and Tina. Not sure why I wasn't called, maybe because I wasn't the first to hear it from Aliyah?

Pretrial is some time in the beginning of October, I can't remember the exact date.

Well, today marks the 1 year mark of the origin of this thread. Trial has started with procedural type stuff taking place and the different police officers involved testifying. I am unable to attend the trial due to the fact that I am to be called as a witness. We have a tour of the courtroom tentatively set for this Friday Jan.3 at 0830 to take the girls down while its not in session and let them look around etc. so that it won't be scary when they have to come back to testify. After I testify I can witness the rest of the trial. I hope I'm one of the first ones, so that I can bear witness to the rest of the trial. I don't want this scum bag to think he has scared me off.

During the pretrial in October the Judge granted all testimony accommodations that we asked for. So the girls will be testifying from outside of the courtroom and all cross examination will be handled by counsel appointed by the court. We also felt it important that the girls weren't called to testify or any preparation happening before all of the Christmas activities took place.

The next court dates are Jan 15,16 with preparations to take place shortly. I'm worried may forget something important but I know it's in there, I just pray I remember everything when it comes time.

With today being the 1 year anniversary it has been a hard day for my wife. BUT we had a tremendous Christmas and girls are all doing great I am so proud of them. :00hour

So on the anniversary of the event that shook my family and truth be told, almost broke me in every sense of the word, I am taking stock. Not only have we survived this event BUT we are thriving. The girls are doing great, I know there is still work to be done but they are all doing exceptionally well. They are all doing well in school (we are homeschooling this year) and they know we love them and most of all we are here for them no matter what may come we will deal with it and overcome. Tina is doing good as well, I think that when everything is finished she will be able to move on. The bottom line is not only did we endure what happened but I believe we have been fortified as a family. God is good :00hour

I want to thank you all my friends for being there, for offering prayers and words of encouragement. I want to reiterate our profound thanks again for your generosity in our time of need :0008

Happy New Year, really good to hear about your family "thriving" as you put it. Brought a tear to my eye reading your post and remembering the shock, disbelief, and horror from when you first posted about this. But at the same time I able to smile reading about how you guys as a family are sticking together and moving forward like you are. Hope 2014 is a great one for you and your family.

I just brought in 2014 with tears of happiness.

My wife just asked me if I was ok and I told her I was reading an update from an amazing father, husband and madjacker.

I wish you continued success as you put this chapter of your life to legal bed. You will do an awesome job on and off the witness stand and I will be waiting for the post that justice shall provide.

My favorite part of this post is knowing that you have already won and it has nothing to do with a judge or jury. That will just be lagniappe on top of the family bonding that you have created.

So me, Aliyah and Kate have an appointment with crown counsel tomorrow. Tony has elected for this matter to be put over to Federal Court, so I believe our original court dates of Jan 16, 17 have become preliminary hearing dates for the Federal case.

Now I have no idea why he would do that. He is still choosing to represent himself, but there has been a lawyer appointed to cross examine the girls. Did he want a new judge? Maybe he knows that he's going down and doesn't want to be incarcerated locally (approx 68 miles away) rather in a Federal Penitentiary? All I know for sure is that because this is a now a Federal case, he can get a higher maximum prison sentence.

I have lots of questions, and they all should be answered tomorrow :toast:

i was really glad to read this. the positive attitude you continue to have is admirable and most helpful to your family in this situation. continued thoughts and prayers for a quick resolution so you can finally put an end to this chapter of your life so you and your family can move forward. good luck... :toast:

So today was basically a meet and greet with the crown counsel. The girls met her and they got a tour of the provincial and federal court rooms. But the thing they were most impressed with was the wheelchair elevator that they got to take a ride in :0002

Friday afternoon we will be going back to go over our testimonies I believe. So court has been booked for this case for Jan 16, and 17 and providing there is enough evidence for trial which there should be enough from Tony's admissions alone, we will be heading for trial some time this spring, but more likely next fall :facepalm:

There is a POSSIBILITY that after seeing the significance of the evidence or lack thereof their might be a plea deal but we'll see. :popcorn2

I took the girls for their follow up meeting with crown counsel. Neither Kate nor Aliyah wanted my in the interview room while they talked to Counsel. Well I should restate that Kate didn't really care one way or the other if I was in there or not, Aliyah was adamant that I was not in the room. It makes me wonder what's going on with her. Is she embarrassed? Does she think she will be in trouble? I don't know, but it breaks my heart, and I can't ask her about it :(

On the bright side, the girls got a full tour including the cells and to sit in the back of a police truck. They thought it was pretty awesome.

Crown Counsel thinks that both girls will do well and seem to remember..........
She made a point of telling both girls numerous times that she doesn't care what they say as long as it is the truth. And also got me to say that it was ok for them to talk to the judge (testify) about what happened even if they were to use language that isn't allowed (fucking) came up from Aliyah's interview and body parts etc.

I need to call that office tomorrow to find out some of the particulars of them testifying whether dick head will be there or if their testimony will be from a different room, etc. etc.

So tomorrow is day 1 of court. Kate and Aliyah will be testifying from behind a screen in the courtroom, with appointed defence counsel doing the cross.

I want to be the one to bring them into the courtroom, not only for them but for me and as a show of support/solidarity. We'll see if that is permissible. I understand I can't be there to hear their testimony as I myself am going to be called, but there shouldn't be any reason why I can't bring them in and leave before testimony takes place. If not me then it will be this wonderful lady Cindy from victims services that we've been dealing with this last year. She is great and the girls love her.

I have no idea of the time frame for tomorrow. Court starts around 9 and when they get to our case then testimony should start, until then I'll be hanging out with my girls in the witness room or in the crown counsel office. It's going to be a long day...

So me and the girls went down to counsel's office for 0900. They brought in a young woman sheriff from the next town (1.5 hrs away) as reinforcement and because she was good with kids. My girls loved her :)

Approx 1030 our case gets under way and the my brother in-law, Damion was called as the first witness. He came back after about 30 mins and was shaking like a leaf, and he's a big scary mofo. Used to be into some bad stuff before getting his life turned around and for the last while has been in security. Jenna (his daughter) was called to the stand but just wasn't able to stop crying long enough to testify, hopefully that in itself says something to the judge :shrug:

There was a break so crown counsel told me to take the girls home for lunch and she would call another complainant from out of town before the lunch break. I would get a call during the afternoon break around 1400-1500hrs. I never got a call, so we spent the afternoon at home instead of the cramped little witness room at the courthouse. I called back at 1630 to see what was going on and their office said that they wouldn't be able to get all of my family in today and were unsure about my childcare arrangements so they didn't want to just have me testify. Well a quick phone call could have answered that :p

Anyways we are all going back tomorrow morning and this all should be done until the real trial (hopefully)


Any thought or comments please reply, I kinda feel like I'm talking out of my ass here and clogging up general

please share what you would like to share and don't ever feel like you're "clogging up general" - I know people are interested and even if they weren't it seems to me like your sharing of information in this forum has served as a cathartic release

Echo what LA Burns stated. Glad things are going as well as possible with the testimony and trial. Would reply with words of encouragement more often but honestly feel like I'm not qualified as what you are going through is something I can't comprehend. Definitely amazed how strong you have been and know that has been helpful to your family. Will keep you and your family in my thought and prayers.
